REHOBOTH MAN AND WOMAN ARE ARRESTED FOR FLEEING FROM POLICE

Ashley A. Hertzog, 31, of Rehoboth Beach, Del. was charged with resisting arrest early Monday (07/23/18) morning after she fled from a Rehoboth Beach Police officer who suspected her and the occupants of a vehicle were smoking marijuana.  

At around 12:45am, a Rehoboth Beach Police officer on patrol in the second block of Baltimore Avenue in the area of the Village by the Sea mall, detected an odor of burnt marijuana coming from a vehicle parked along the roadway.  The officer observed Hertzog leaning inside the passenger side window of the vehicle.  The officer contacted Hertzog in an attempt to investigate the odor.  Even though they were told they were not free to leave, Hertzog and the female passenger of the vehicle fled on foot through the Village by the Sea mall.  As the female passenger exited the vehicle, the officer observed her place what appeared to be a bag of suspected marijuana inside the vehicle.  The officer also observed paraphernalia inside the vehicle commonly associated with the consumption of marijuana. 

As the females fled from the vehicle, the officer remained with the driver who was later identified as Rickey C. Garner Jr., 35, of Rehoboth Beach, Del.  The officer ordered Garner to exit the vehicle at which time he fled the scene in the vehicle at an unsafe speed east bound on Baltimore Avenue toward First Street where the officer lost sight of the vehicle. 

During a search of the area, the officer later located Hertzog inside Arena’s, which is located in the Village by the Sea mall where she was taken into custody without further incident. 

Hertzog was arrested and charged with 1 misdemeanor count of resisting arrest and committed to Sussex Correctional Institution in default of $500.00 secured bail.

The Rehoboth Beach Police Department issued warrants for the arrest of Rickey C. Garner, Jr.  He turned himself into police on Tuesday, July 24th, 2018 at around 5:00pm.  

Garner was arrested and charged with 1 count of consuming marijuana of a personal consumption quantity, 1 count of resisting arrest, both misdemeanors, as well as, 1 count of driving a vehicle at an unreasonable or imprudent speed, and 1 count of failure to stop at a stop sign.  

Garner was released on $700.00 unsecured bail.

The female passenger of the vehicle has not been identified at this time.
