Eugene F. Abernathy Jr., 31, of Bowie, Md. was charged with unlawful imprisonment after his girlfriend reported to police that during the course of an argument he became physical and restrained her in an attempt to prevent her from leaving a residence in the 1000 block of Scarborough Avenue Extended.

On Thursday morning, just after midnight, Rehoboth Beach Police officers were called to respond to the Newbold Square townhome complex for a report of a physical domestic disturbance.  When police arrived on scene, the female victim had managed to escape the residence while Abernathy remained inside.

Officers investigated the incident and interviewed multiple people on scene.  The investigation revealed that Abernathy and his girlfriend were having an argument in the living room of the residence that became physical.  The victim attempted to get away from Abernathy by fleeing to the bedroom, but he followed.  Abernathy threw the victim onto the bed and held her down in an attempt to prevent her from leaving.  The victim bit Abernathy and was able to get free and spray Abernathy with pepper spray, which she had attached to her key chain.  The victim was then able to flee the residence and get into her car.  Abernathy approached the victim again while she was seated in her car and kicked the car multiple times denting the driver’s side door.  During the altercation the victim sustained a small cut near the top of her forehead.

Officers were able to take Abernathy into custody on scene without incident. Abernathy, pictured, was arrested and charged with 1 count of second degree unlawful imprisonment, 1 count of criminal mischief between $1000 and $5000 in damages, and 1 count of offensive touching. Abernathy was arraigned via videophone out of the Justice of the Peace Court 3, issued a $3500.00 secured bail and committed to the Sussex Correctional Institution.  A no contact order was issued between Abernathy and the victim.
