James E. Leone, 51, of Wilmington, Del. was arrested for a third offense charge of driving under the influence of alcohol, a felony, after being stopped by Rehoboth Beach Police for committing a traffic violation.
On Saturday (08/26/17) at around 11:00pm, a Rehoboth Beach police officer, who was sitting stationary at a stop sign along Wilmington Avenue, observed Leone, who was operating a silver Jeep Wrangler with Delaware registration, illegally pass him on the right. The officer then began to follow Leone when he observed him drive over the curb and sidewalk at the intersection of Rehoboth Avenue and First Street.
The officer stopped Leone along Rehoboth Avenue and upon approaching his vehicle observed that Leone was showing signs of intoxication. Standardized roadside field sobriety testing procedures were followed and Leone was eventually taken into custody and transported to the Beebe Healthcare for further analysis.
Leone was arrested and charged with 1 count of felony third offense driving a vehicle under the influence of alcohol, 1 count of passing on the right, and 1 count of driving a motor vehicle on a sidewalk.
Leone was released on $5,250.00 unsecured bail to a sober co-signer.
