REHOBOTH MAN CHARGED WITH 4TH DUI

Rehoboth Beach, Del. Justin M. Martine, 36, of Rehoboth Beach, Del. was arrested Wednesday night for his fourth offense of driving a vehicle under the influence of alcohol after he was stopped for committing a traffic violation. 

At around 8:00pm on September 11, 2019, a Rehoboth Beach Police officer observed Martine, who was operating a silver Jeep Compass with Delaware registration, turn left from First Street onto Rehoboth Avenue westbound.  The intersection is signed for no left turns from all directions.  Martine struck the curb, rupturing the front right tire.  The officer, who was on foot, relayed this information to officers on vehicle patrol.  Martine was located by a second officer on Rehoboth Avenue just west of Second Street closely following another vehicle.  The officer activated his emergency lights and initiated a traffic stop.

Upon approaching the vehicle and making contact with Martine, the officer observed that he showed signs of intoxication.  Subsequently, Martine was administered standardized field sobriety tests and arrested for driving under the influence of alcohol. Martine was transported back to the Rehoboth Beach Police Department for further testing at which time the officer determined that he had three prior DUI related convictions making this his fourth offense and a felony.

Martine is currently on probation and alcohol monitoring as a result of his conviction for a third offense DUI.  Delaware Probation and Parole was contacted and they obtained an administrative warrant for Martine for violating the conditions of his probation.

Martine was arrested by the Rehoboth Beach Police Department and charged with 1 count of fourth offense driving a vehicle under the influence of alcohol, which is a felony.  He was also charged with 1 count of driving with a suspended or revoked license, 1 count of failure to have insurance identification in possession, 1 count of failure to have the vehicle registration card in possession, 1 count of failure to obey a traffic control device, 1 count of following a motor vehicle too closely, and 1 count of failure to report a change of address, which are all traffic misdemeanors.
