MILLSBORO MAN CHARGED WITH 5TH DUI OFFENSE

Patricio A. Bautista, 33, of Millsboro, Del. was arrested late Monday (08/03/20) evening for his fifth offense of driving a vehicle under the influence of alcohol after he was stopped for committing a traffic violation. 

At around 11:00pm, a Rehoboth Beach Police officer observed Bautista, who was operating a black Mazda 3 with Delaware registration, make an illegal left turn from Second Street northbound onto Rehoboth Avenue westbound.  The officer pursued Bautista and upon catching up to him observed that he was traveling at a speed in excess of the posted speed limit.  The officer activated his emergency equipment.  Bautista did not immediately pull over but eventually did so along Rehoboth Avenue Extended.

Upon approaching the vehicle and making contact with Bautista, the officer observed that he showed numerous signs of intoxication.  Subsequently, the officer attempted to administer Bautista standardized field sobriety tests but he ultimately refused.  Based on the clear and evident signs of intoxication Bautista was arrested for driving under the influence of alcohol.  Bautista was transported to the Beebe Health Campus for further testing.  Once he was in custody, through investigative means, the officer was able to determine that Bautista had four prior DUI related convictions making this his fifth offense and a felony.  It was also discovered that Bautista’s driver’s license was suspended.  

Bautista was arrested and charged with 1 count of felony fifth offense driving a vehicle under the influence of alcohol, 1 count of driving while suspended or revoked, 1 count of failure to obey a traffic control device, 1 count of speeding, 1 count of failure to have registration card in possession, and 1 count of failure to have insurance identification in possession.

Bautista was committed to Howard R. Young Correction Institution in lieu of $6750.00 secured bail.
