Justin A. Davis, 17, of Millsboro, Del. was arrested Wednesday (10/26/16) evening after his involvement in an altercation near the Rehoboth Beach Bandstand which led to him threatening Anthony R. Merlo-Tijerino, 19, of Lincoln, Del. with a knife. Merlo-Tijerino was also arrested for his involvement in the altercation.
At around 6:10pm, officers from the Rehoboth Beach Police Department were dispatched to the area of the Bandstand for reports of a fight in progress. Upon arrival, the parties were separated and police were able to obtain statements from multiple witnesses to the altercation. According to witness accounts, Davis and a friend were arguing and play fighting when Merlo-Tijerino attempted to video record them using his cell phone. Davis confronted Merlo-Tijerino at which time Merlo-Tijerino responded with abusive, race based language. Davis reacted by retrieving a knife from his vehicle and advancing toward and threatening Merlo-Tijerino causing him to back up.
Both Davis and Merlo-Tijerino were taken into custody on scene without incident or injury.
Davis was arrested and charged with 1 count of felony aggravated menacing, 1 count of felony terroristic threatening, and 2 counts of misdemeanor disorderly conduct. Davis was released to a guardian.
Merlo-Tijerino was arrested and charged with 1 count of misdemeanor disorderly conduct. Merlo-Tijerino was released on a $500.00 unsecured bond.
