Summary

This Ordinance makes adjustments to zoning provisions relating to Natural Area, Floor Area Ratio, Lot Coverage, Rear Yards, and Accessory Buildings.

Non-Conforming Structures

The term “Non-Conforming” has been much talked about in relation to the recent changes to the city’s zoning code.  Our

 is provided to clarify what is meant by this term and how it is applied within the zoning code in relation to the changes enacted on July 17, 2015.

Current Status

Pursuant to Section 41A of the City’s Charter a Special Election will be held on Saturday, November 7, 2015 from 11:00 a.m. to 7:00 p.m. at the Rehoboth Beach Volunteer Fire Company located at 219 Rehoboth Avenue, Rehoboth Beach, Delaware. The referred Ordinance is known as Ordinance No. 0715-01, titled “An Ordinance to Amend Chapter 270, Zoning, of the Municipal Code of Rehoboth Beach, Delaware, 2001, Relating to Natural Area, Floor Area Ratio, Lot Coverage, Rear yards and Accessory Buildings” and was adopted by the Commissioners on July 17, 2015.

If the majority of the residents and property owners voting on Ordinance No. 0715-01 vote against the ordinance, it will be considered repealed upon the certification of the result of the election by the Board of Special Election.

Voting machines will be used to tally the votes. A sample of the ballot for the Special Election is enclosed. A duly registered voter may cast his/her vote by absentee ballot at the Special Election, if the voter is unavailable to vote in person during the hours of the election. An Affidavit must be completed and filed at City Hall no later than 12:00 noon the day before the Election (November 6, 2015).  Affidavits for absentee ballots are available at the Office of the City Manager, City Hall, 229 Rehoboth Avenue, Rehoboth Beach, Delaware.  Absentee ballots will be sent to everyone who has an Affidavit on file.  The deadline for the City to mail ballots is the last Tuesday prior to the Election, November 3, 2015.  Ballots MUST be received by mail or in person before the Polls close on the day of the Election.

Only persons registered to vote on the Books of Registered Voters of the City are entitled to vote in the Special Election, either in person or by absentee ballot. If an individual is already registered to vote on the Books of Registered Voters of the City, it is not necessary to register again in order to vote in the Special Election. If an individual is not registered to vote on the Books of Registered Voters of Rehoboth Beach, he/she may register to vote at the Office of the City Manager, City Hall, 229 Rehoboth Avenue, Rehoboth Beach, Delaware, during regular business hours until the close of business on Friday, October 30, 2015.
